What can't
I sell?
· Illegally
copied items that infringe Copyright and Trade Mark Law. The counterfeit laws
apply to all
articles of clothing, hats, footwear, sunglasses, watches, cosmetics &
perfume, pirated DVD's,
CD's, Videos, Audiotapes, Software, Floppy Discs, PlayStation / X-box games and all new-copied
goods.*
· No
Food, Drink or Confectionary unless prior approval of Management.
· No
protected Flora or Fauna.
· No
Drugs or Medicines, Alcohol, dangerous or offensive items.
· No
Firearms or Weapons, Pornographic or any other materials deemed objectionable by
Management.
What can I
hire?
· Stall
spaces (5.5m frontage x 4m deep), which allow for a Car & Trestle or Tent &
Trestle.
Stalls and
market sites are allocated at the management's discretion.
· An
extra half space must be hired to accommodate vehicles with trailers.
· Market
Tent, (3m x 3m) or (6m x 3m), limited number available for hire.
· Trestle
tables (1.83m x .76m), limited number available for hire.
Does
my stall space have any power?
· Generally
No, but a limited number of stalls can have power by arrangement with
management.
$5 fee applies for consumption
and setup. Must supply extension lead that is capable of
carrying the
load, and meets
electrical safety standards. Special requirements,
(Leads, 3 phase etc) by arrangement.
Do I
need to book a space?
· No
Are
Charities entitled to free stall space?
· Yes.
Charities and Fund Raising Groups are permitted one free stall space, but only
by prior
arrangement with Management.
Minimum four weeks notice required.
Can I
use Loud Speakers on my stall?
· No,
stallholders are prohibited from disturbing other market participants by
shouting,
playing loud music or making sounds to draw attention to their wares.
Am I
allowed to erect an umbrella, canopy or marquee ?
· Yes,
providing they are securely weighted down with sand bags – no tent pegs are
allowed as it will damage the asphalt. Sellers must also ensure that umbrellas, canopies
and guy ropes do not pose a risk
to market patrons on their stall site, or by protruding
beyond allocated stall space or overhanging walkways.
Do I
have to clean up afterwards?
· Yes.
It is the stallholder's responsibility to take their own rubbish and unsold
items with
them, leaving stall spaces clean and tidy. Bins are on site for buyer litter and food scraps
only. If any
stallholder leaves rubbish behind, their registration number will be
reported to the EPA. All statutory littering provisions are applicable in
the market area.
GENERAL STALLHOLDER TERMS & CONDITIONS:
Fees & Insurance
- All
casual stall fees are payable at time of admission.
-
Stallholders must carry appropriate insurance if required.
Cancellations and Refunds
-
NO
refunds are given for cancellations.
-
Markets will operate in varying weather conditions and stallholders must be
prepared for adverse weather.
-
Stallholders may pack up their stall due to adverse weather conditions but may
not move unless permission is given by Management.
-
No
refunds/credits are given for the cancellation of markets due to adverse
weather conditions by the stallholder and/or Management.
-
Management will not be held responsible for any loss, damage or injury
whatsoever resulting from adverse weather conditions.
Occupational Health and Safety
-
Stallholders must drive within the market area at a safe speed that is no
greater than 10km.
-
All
vehicles must not move in market area 15 min. prior and 15 Min. after market
advertised buyer trading times.
- No
DOGS are permitted to enter the market area.
-
Within
market area, smoking is not permitted at any stall site, in
buildings or confined areas.
Waste and Rubbish Removal
-
Stallholders are required to remove their own rubbish and waste from their
immediate stall location. Boxes & cartons must be
removed from market area.
Failure to do so may result in a levy imposed.
-
The
waste bins provided at the markets are for the general public use only.
-
Stallholders are responsible for leaving their site and surrounding area
clean, tidy and undamaged.
Stall Set-up and Equipment
-
Stallholders must provide their own covers and stall set-up which must be good
in presentation.
-
Management hire out a limited number of marquees and trestle tables to
stallholders. Arrangements for
hire at time of pre-booking or admission.
-
All
stall equipment including racks, tables, signage etc must be contained to the
stall site boundaries.
Public access ways must be clear at all times.
-
Tents,
covers and all stall equipment must be erected securely and weighted or
secured at all times.
-
All
equipment must in good repair and be operated in a safe manner.
Food stalls
-
It is
the Stallholders responsibility to apply to the local Shire/council (Health
and Environmental Services department) and obtain and
pay any registration
required.
-
Stallholders must supply copies of registration with their local council and
also the council in which they are trading, to Management.
-
Food
stallholders must comply with any local, state & federal health regulations
and food acts.
-
Failure to comply with health department standards and regulations may result
in immediate closure of stall and future stalls may only be
reinstated once
Management are satisfied all standards and regulations have been adhered to.
Power/Gas Equipment
-
Powered sites are limited and power outlets may only be used with the
permission of Management and payment for power consumed..

Stallholders must ensure that all electrical equipment and leads be tagged in
compliance with relevant workplaces regulations.
-
Stallholders must ensure that all gas appliances are approved and in date.
-
Stallholders using gas/electrical appliances must have a suitable fire
extinguisher or fire blanket on site.
-
It is
the responsibility of the stallholder to ensure they conform to any safety and
compliance standards pertaining to their equipment.
- If
management observes any unsafe situation, the stallholder will be directed to
immediately correct the situation, or cease using the device.

Testing of any electrical device can only be facilitated through the use of an
Earth leakage device
STALLHOLDER CODE OF CONDUCT:
-
Stallholders must
follow any direction given by management.
-
Stallholders must present their stall in a neat and pleasing manner.
-
Stallholders must not act in a verbally or physically abusive, dangerous, or
disruptive manner, any breach will result in immediate termination.
-
Stallholders must ensure that their activities do not endanger the safety or
security of any people at Markets.
-
Stallholders must not cause damage, make alterations or additions of any
nature to, or carry out works of any nature to market site property
and that,
if any damage is caused, the costs of any repairs, making good or replacement
are borne by the stallholder.

Stallholders must comply with all the terms contained in these regulations and
must comply with any changes to the market regulations,
or any relevant local
government and other statutory laws & regulations
-
Stallholders must report to the Management any incident or accident to any
person or property that involves loss or could be expected to
give rise to a
claim.
TERMINATION:
The Manager reserves the right to withhold consent to a
stallholder to occupy a stall at the market,
to remove or to have removed from the market, a stallholder who is in breach or
does not comply
with the regulations, including where a stallholder:

Fails
to pay their stall fee in a timely manner

Fails
to abide by the markets set up or pack up conditions

Fails
to abide by the market’s trading hours
-
Fails
to abide by the terms and conditions of the market’s rules and regulations
-
Commits a criminal act at the market
-
Behaves in a manner that breaches the market’s Code of Conduct
